About These Terms
These Terms of Engagement govern the provision of all consultancy, inspection, reporting, and advisory services by Plumb Standard ("we", "us", "our") to clients ("you", "the client"). By engaging our services or accepting a fee proposal, you agree to these terms.
These terms should be read in conjunction with any written fee proposal or scope of works provided to you. Where a conflict exists between these terms and a specific written engagement, the specific written engagement takes precedence.
2.0
Service Area
Plumb Standard provides on-site inspection and consultancy services throughout Tasmania, including but not limited to:
- Greater Hobart and the Southern region
- Launceston and the Northern region
- North-West Coast and Burnie region
- East Coast and Midlands
- Huon Valley, Derwent Valley, and remote southern areas
Remote and desktop consultancy services — including legislation interpretation, application review, technical advice, and written opinions — are available to clients in all Australian states and territories. Travel costs and timeframes for regional and remote Tasmanian locations will be outlined in the fee proposal.
3.0
Scope of Services
The scope of each engagement will be defined in a written fee proposal provided prior to commencement. Services may include, but are not limited to, independent inspections, pre-purchase inspections, insurance assessments, technical reports, permit application reviews, legislative advice, and council liaison assistance.
Any variation to the agreed scope during an engagement — including the discovery of additional works, access requirements, or extended documentation — will be communicated promptly. Additional fees may apply and will be agreed before additional work is undertaken.
4.0
Nature of Advice and Limitations
Important: The following limitations apply specifically to general information provided on this website and in preliminary communications prior to a formal engagement. Formal reports, site inspection findings, and advice provided under a confirmed engagement are professional opinions based on direct assessment and carry appropriate professional weight.
Information published on this website, including service descriptions and FAQ responses, is provided for general informational purposes only. It does not constitute professional advice and should not be relied upon as a substitute for obtaining specific advice tailored to your circumstances.
Where a formal engagement has been confirmed and a site inspection or detailed assessment has been conducted, the findings and recommendations provided are professional opinions based on direct observation, applicable standards, and the information made available at the time of assessment. These are not general in nature.
All advice and reports are prepared based on information available and conditions observable at the time of engagement. We accept no responsibility for matters that:
- Were concealed, inaccessible, or not made available for inspection
- Arose or changed after the date of inspection or report
- Were outside the agreed scope of the engagement
- Result from reliance on incomplete or inaccurate information provided by the client
Reports and opinions are prepared for the specific client and purpose stated in the engagement. Third parties who rely on our reports without our written agreement to extend reliance do so at their own risk.
5.0
Fees and Payment
Fees are provided by written proposal prior to commencement of any chargeable work. No fee is payable for an initial enquiry or the provision of a fee proposal. Commencement of work is conditional on written acceptance of the fee proposal by the client.
Unless otherwise stated in a fee proposal, payment is due within 14 days of invoice. Invoices are issued on completion of the engagement or at agreed milestones for longer engagements. Overdue accounts may incur a late payment fee and may result in suspension of further work until the account is settled.
Quoted fees are inclusive of GST where applicable. Travel costs for site visits outside the Greater Hobart area will be itemised in the fee proposal.
6.0
Client Obligations
To enable us to deliver services effectively, the client agrees to:
- Provide accurate and complete information relevant to the engagement
- Arrange reasonable access to the property or documentation required for the engagement
- Notify us promptly of any changes to the site, works, or circumstances relevant to the scope
- Not misrepresent the intended use of any report or opinion we provide
We reserve the right to suspend or withdraw from an engagement where a client fails to meet these obligations or where circumstances arise that would prevent us from providing advice consistent with applicable standards.
7.0
Confidentiality
We treat all client information as confidential. Information provided to us in the course of an engagement will not be disclosed to any third party without your consent, except where required by law or where necessary for the delivery of the service (for example, liaison with a council authority on your behalf).
Reports and written opinions prepared for a client are provided for that client's use only. Reproduction, distribution, or publication of our reports without prior written consent is not permitted.
8.0
Limitation of Liability
To the maximum extent permitted by law, Plumb Standard's liability for any loss or damage arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential, or economic losses arising from reliance on our advice or reports, including decisions made by third parties on the basis of our findings.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or any other applicable legislation. Where such protections apply, our liability is limited to the extent permitted by law.
We maintain appropriate professional indemnity insurance for formal engagements. Details of coverage are available on request.
9.0
Conflicts of Interest
Plumb Standard operates as an independent consultancy with no commercial relationship to plumbing contractors, product suppliers, or installation businesses. We will disclose any potential conflict of interest to the client prior to accepting an engagement and will decline work where an unresolvable conflict exists.
10.0
Governing Law
These terms are governed by the laws of Tasmania, Australia. Any dispute arising from or relating to these terms or an engagement shall be subject to the jurisdiction of the courts of Tasmania.
